Welcome to Estimt.

These Terms of Use ("Terms") govern your access to and use of Estimt.com and any related websites, applications, software, products, and services provided by Estimt ("Estimt," "we," "us," or "our").

By accessing or using Estimt, you agree to these Terms. If you do not agree, you should not use the Services.

1. Description of Estimt

Estimt provides technology and software designed to help homeowners and home-service professionals with estimating, lead generation, project information, contractor connections, business management, and related services.

Estimt may provide AI-generated estimates, recommendations, calculations, or other information.

Estimt is a technology platform and is not itself a plumber, HVAC contractor, electrician, general contractor, construction company, or other home-service professional unless expressly stated otherwise.

2. Estimates Are Estimates Only

Any estimate, price range, calculation, recommendation, or project information generated through Estimt is provided for informational purposes.

An estimate is not a guaranteed final project price.

Actual project costs may vary because of:

  • Labor
  • Materials
  • Property conditions
  • Accessibility
  • Measurements
  • Scope changes
  • Permits
  • Local regulations
  • Contractor pricing
  • Product availability
  • Unexpected conditions
  • Other project-specific factors

Homeowners should obtain an appropriate inspection, measurements, and final quote from a qualified professional before beginning a project.

3. AI-Generated Information

Estimt may use artificial intelligence to generate estimates, recommendations, descriptions, summaries, or other content.

AI-generated information may contain errors, omissions, outdated information, or inaccurate assumptions.

You are responsible for independently verifying important information before relying on it.

Estimt does not guarantee that AI-generated information will be accurate, complete, current, or appropriate for your particular project.

4. Contractor Information

Estimt may provide homeowners with access to contractors or service professionals.

Estimt does not guarantee:

  • The quality of a contractor's work
  • Contractor availability
  • Contractor licensing
  • Contractor insurance
  • Contractor pricing
  • Contractor workmanship
  • Contractor experience
  • Contractor representations
  • Project completion
  • Contractor performance

Homeowners are responsible for evaluating and selecting contractors and should independently verify licenses, insurance, qualifications, references, pricing, and other information as appropriate.

Any agreement for home services is between the homeowner and the applicable contractor unless Estimt expressly states otherwise.

5. Contractor Responsibilities

Contractors using Estimt are responsible for:

  • Providing accurate business information
  • Providing accurate pricing and service information
  • Maintaining required licenses and permits
  • Maintaining required insurance
  • Complying with applicable laws and regulations
  • Providing accurate representations to customers
  • Performing services professionally
  • Managing their customers and projects appropriately

Contractors are solely responsible for the services they provide to customers.

6. User Accounts

Certain features may require you to create an account.

You agree to provide accurate and current information and to keep your login credentials secure.

You are responsible for activity occurring under your account.

You must notify Estimt if you believe your account has been accessed without authorization.

7. Acceptable Use

You agree not to:

  • Use Estimt for unlawful purposes
  • Provide false or misleading information
  • Impersonate another person or business
  • Attempt to gain unauthorized access to the Services
  • Interfere with the operation of Estimt
  • Upload malicious software or harmful code
  • Scrape or systematically collect information without authorization
  • Reverse engineer or attempt to reproduce proprietary technology
  • Use the Services to violate another person's rights
  • Abuse lead-generation or communication features
  • Use the Services to spam, harass, threaten, or deceive others

We may suspend or terminate accounts that violate these Terms.

8. User Content

You may provide information, photographs, descriptions, reviews, project details, business information, and other content through the Services ("User Content").

You retain ownership of your User Content.

By submitting User Content, you grant Estimt a non-exclusive, worldwide, royalty-free license to host, store, reproduce, process, modify, display, and use that content as reasonably necessary to operate, provide, improve, and promote the Services.

You represent that you have the rights necessary to provide the User Content and that your content does not violate applicable laws or third-party rights.

9. Payments and Fees

Certain Estimt features may require payment.

If you purchase a paid service, you agree to pay all applicable fees presented to you at the time of purchase.

Unless otherwise stated, fees may be non-refundable except where required by law or expressly provided by Estimt's applicable refund policy.

Estimt may change pricing with appropriate notice where required.

10. Intellectual Property

The Services and their contents, including software, designs, logos, trademarks, text, graphics, interfaces, features, and other materials, are owned by or licensed to Estimt and are protected by applicable intellectual-property laws.

Except as expressly permitted by these Terms, you may not copy, modify, distribute, sell, lease, reverse engineer, or create derivative works from the Services.

11. Third-Party Services

Estimt may integrate with or link to third-party services.

Third-party services may have their own terms and privacy policies.

Estimt is not responsible for the availability, functionality, security, or performance of third-party services.

12. Disclaimers

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE."

ESTIMT DISCLAIMS WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WARRANTIES OF ACCURACY, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, AND AVAILABILITY.

WE DO NOT GUARANTEE THAT THE SERVICES WILL ALWAYS BE AVAILABLE, ERROR-FREE, SECURE, OR ACCURATE.

ESTIMT DOES NOT GUARANTEE THAT ANY ESTIMATE, CONTRACTOR MATCH, LEAD, PROJECT RESULT, COST, SAVINGS, OR OTHER OUTCOME WILL MEET YOUR EXPECTATIONS.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ESTIMT AND ITS OWNERS, OFFICERS, EMPLOYEES, CONTRACTORS, AFFILIATES, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING FROM OR RELATED TO YOUR USE OF THE SERVICES.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ESTIMT'S TOTAL LIABILITY ARISING FROM OR RELATING TO THE SERVICES WILL NOT EXCEED THE GREATER OF:

  1. THE AMOUNT YOU PAID TO ESTIMT FOR THE SERVICES DURING THE TWELVE MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM; OR
  2. $100.

Some jurisdictions do not permit certain limitations, so some provisions may not apply to you.

14. Indemnification

To the maximum extent permitted by law, you agree to defend, indemnify, and hold harmless Estimt and its owners, officers, employees, affiliates, contractors, and service providers from claims, damages, liabilities, losses, and expenses arising from:

  • Your use of the Services
  • Your User Content
  • Your violation of these Terms
  • Your violation of applicable law
  • Your violation of another person's rights

15. Suspension and Termination

We may suspend or terminate your access to the Services if we believe you have violated these Terms, created a security risk, engaged in fraudulent activity, or otherwise misused the Services.

You may stop using the Services at any time.

Provisions that by their nature should survive termination will continue to apply.

16. Changes to the Services

We may modify, update, suspend, or discontinue portions of the Services at any time.

We are not responsible for losses resulting from changes, interruptions, or discontinuation of the Services except where required by applicable law.

17. Changes to These Terms

We may update these Terms periodically.

When we make material changes, we may provide notice through the Services or other reasonable means.

Your continued use of Estimt after updated Terms become effective constitutes acceptance of the revised Terms.

18. Governing Law

These Terms will be governed by the laws of the State of California, without regard to conflict-of-law principles, unless applicable law requires otherwise.

Any dispute that cannot be resolved informally will be handled in a court of appropriate jurisdiction as permitted by applicable law.

19. Severability

If any provision of these Terms is determined to be invalid or unenforceable, the remaining provisions will remain in effect.

20. Entire Agreement

These Terms, together with any additional terms expressly incorporated by reference, constitute the agreement between you and Estimt regarding your use of the Services.
